Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the SF Art Map website, applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be legally bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that:
- You meet the minimum age requirement;
- You have the legal capacity to enter into these Terms;
- Your use of the Service will comply with all applicable laws and regulations.
2. Account Registration
To access certain features, you may be required to create an account.
You agree to:

- Maintain the security of your account credentials;

3. Community Standards and User Conduct
SF Art Map is a community-driven platform dedicated to public art discovery and appreciation. To maintain a respectful and lawful environment:
A. Prohibited Content
You may not upload, post, or transmit content that:
- Is unlawful, defamatory, threatening, abusive, harassing, hateful, or discriminatory;
- Contains pornography or sexually explicit material;
- Encourages illegal activity;
- Infringes upon intellectual property rights;
- Violates the privacy rights of others;
- Contains malware, malicious code, or harmful software.
B. Intellectual Property Responsibility
You may only upload:
- Photographs that you personally created; or
- Content for which you have explicit legal permission to publish.
You represent and warrant that you possess all necessary rights to submit your content.
C. Moderation and Enforcement
We reserve the right, in our sole discretion, to:
- Remove any user-generated content;
- Suspend or permanently terminate user accounts;
- Restrict access to the Service;
at any time and without prior notice if these Terms are violated.
4. User Content License
By submitting content to the Service, you grant SF Art Map a non-exclusive, worldwide, royalty-free license to:
- Display, reproduce, and distribute your submitted content within the Service;
- Use submitted content for promotional materials related to the Service;
- Modify content solely for formatting, display, or technical purposes.
You retain ownership of your intellectual property.
5. Walking Routes & Physical Safety Disclaimer
The Service includes route-building and navigation features designed for informational and recreational purposes.
A. No Guarantee of Conditions
We do not guarantee:
- The safety, accessibility, or legality of any route;
- The absence of construction, closures, or hazards;
- Adequate lighting, pedestrian infrastructure, or ADA accessibility;
- The current existence or visibility of any artwork.
Real-world conditions change frequently.
B. Assumption of Risk
By using routing or navigation features, you acknowledge and agree that:
- You are solely responsible for your personal safety;
- You assume all risks associated with walking or traveling to locations identified through the Service;
- SF Art Map, its creators, affiliates, and service providers are not liable for injuries, property damage, losses, or disputes arising from your use of route suggestions.
You agree to exercise independent judgment and situational awareness at all times.
6. Accuracy of Information
Public art is dynamic and subject to removal, relocation, alteration, or damage.
While we strive for accuracy, we do not warrant that:
- Map markers are current or precisely located;
- Artwork is accessible or publicly viewable;
- Descriptions or metadata are complete or accurate.
The Service is provided on an “as-is” and “as-available” basis.
7. Intellectual Property Rights
All platform content, including but not limited to:
- Software
- Design
- Logos
- Map compilation structure
- Branding
- Platform layout
is owned by or licensed to SF Art Map and is protected by intellectual property laws.
You may not:
- Copy, modify, distribute, reverse-engineer, or commercially exploit any portion of the Service without written permission.
8. Prohibited Uses
You agree not to:
- Use automated scraping tools or bots to extract data;
- Attempt to interfere with the Service’s security features;
- Impersonate other users;
- Use the Service for commercial resale without authorization;
- Upload false or misleading art listings.
9. Third-Party Services
The Service may rely on third-party providers (such as map and hosting services). We are not responsible for:
- The availability of third-party services;
- The accuracy of third-party data;
- The practices of third-party platforms.
Your use of third-party services may be governed by their own terms.
10. Limitation of Liability
To the fullest extent permitted by law:
SF Art Map, its founders, affiliates, employees, contractors, and service providers shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages;
- Personal injury;
- Property damage;
- Loss of data;
- Loss of profits;
- Legal disputes arising from user interactions or route usage.
If liability is found, our total cumulative liability shall not exceed the amount paid by you (if any) for use of the Service during the preceding twelve months.
11. Indemnification
You agree to indemnify and hold harmless SF Art Map and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the Service;
- Your violation of these Terms;
- Your infringement of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice.
Upon termination:
- Your right to use the Service ceases immediately;
- Certain provisions (including liability limitations and indemnification) survive termination.

- Modify or discontinue the Service at any time;
- Update these Terms periodically.
Material changes will be reflected by updating the “Effective Date.” Continued use of the Service constitutes acceptance of revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
